Copyright Laws: Challenges In The Digital Era

1. Introduction:

Development of new technology increased the demand of protection of intellectual property. Creativity has always enriched the development of a new civilization with new ideas and thoughts which helps in blossoms the civilization ahead. India is a land where lot of rich culture and heritage with the diverse forms of performing art, classical music and geographical divergence and also there so many intellectual achievements we can identify easily. With the emergence of globalization of telecommunication and decentralized communication system has made it possible to exchange idea, data, information or any other electronic files from one place to another place on the earth, with the help of personal internet device or any other communication services.

India is the second largest online market in the world, it has approximately 560 million internet users and estimated to reach 650 million by 2023.1 With the increase of technological use now in every sector like education, companies, innovation etc, it has made very common to create, share and copy information or creation without the proper authorization of creator of that content or author of that material. Thus increasing use of digitalization in every sector has possessed a big challenge for policy makers in India as well as other nations also, to protect the intellectual rights of the author or owner of the rights. Technological advancement has made it easy to manipulate any work or product with some little modification which can infringe the protected rights of the author or creator. With increasing use of technological advancement, rapid digitalisation of data or information has made it possible to create duplicate and cheap of copyright materials or creative work, which can be distributed anywhere in the world with just a click with the help of internet. Digitalization has made it easy to copy and paste any materials or files, information, and data and electronic communication has surely made life easy for us to access any material with the help of internet. But at the same there are some risk also originated with origin of digital world and now those risk become the greatest task for the government to regulate such unauthorized use of data and for this government must make some suitable rules and regulations which can help in the protection of rights of the people in the cyberspaces.
