ABSTRACT

When we talk about public health emergencies, we often connect it to the lawful power designated to the government institutions to take measures to restrain or limit diseases and their communication. Therefore, this article examines various aspects of public health emergencies and the role as well as the power of the judiciary during health emergencies. “The body is the means of fulfillment for Dharma.” It was the expression of the yogi Shiva indicating the importance of the body for any penance. Therefore, in social democracy, it is the duty and responsibility of the state to make sure the formation, modeling, and helping conditions are compatible with good health. Judiciary acts as a protector of rule of law that can be extremely applicable during any pandemic or public health emergency. Judiciary may sanction actions to safeguard public health. Lawful aliveness and awareness of public health play an important role in how the courts are indulged in health issues worldwide. In this Article, we broadly discuss how the judicial system performs its vital role and informs what public health specialist ought to know about the judiciary and its functions during a public health emergency. Also, the urgency of keeping the courts open during such an emergency.
