ABSTRACT
The concept of Kafa in Islam holds a significant place in Islamic jurisprudence and ethics, and its relevance in modern times cannot be overstated. Kafa, often referred to as "equality" or "compatibility," primarily concerns the suitability of a potential spouse in terms of social status, lineage, and financial standing. While this concept has been a cornerstone of Islamic family law for centuries, its applicability and implications in contemporary society warrant careful examination. This research paper delves into the multifaceted concept of Kafa in Islam, its historical context, and its contemporary significance. It explores how Kafa, initially intended to ensure marital compatibility, has evolved in response to changing social dynamics, globalization, and the integration of Islamic principles into modern legal systems.
This paper analyzes the relevance of Kafa in the context of the modern world. We investigate whether Kafa, with its emphasis on compatibility, is still a pertinent criterion for marriage in a globalized and diverse society. We consider the challenges posed by cultural diversity, gender equality, and changing economic structures. The research also scrutinizes the legal implications of Kafa in contemporary Islamic family law systems and its alignment with modern legal principles.
