Comparative Study Of The Legislative/Parliamentary Control of Delegated Legislation: India And UK

ABSTRACT

Delegated legislation is one of the most debated issues in legal theory due to its various implications and it has been a widespread practice in modern times. The development of legislative powers of the administrative authorities through administrative rule-making is veryimportant in the study of administrative law. The main objective of the parliamentary control is to monitor the delegated legislation and authorities and also to provide an opportunity to theparliament to criticize the delegates in case of abuse of power. This paper mainly focuses on the concept of parliamentary control over delegated legislation and a comparative study is being done between India and UK. The paper focuses on the concept of parliamentary control, forms of parliamentary control over delegated legislation, and the effectiveness of parliamentary control in administrative rule-making and also gives suggestions to rectify the flaws in the current system.
