Comparative Study Of Constitutional Torts Across Various Legal Systems

ABSTRACT


Torts are civil wrongs that cause a person to suffer some loss or injury as a result of any wrongful act done by the other person. In this context the government may also be held liable for tort as a party. The concept of vicarious liability plays a major role to hold the state tortuously liable. The concept of tortious liability has evolved for various years across various legal systems- English law, American law and Indian law. The Constitution of India provides, under the Articles 294 and 300 provides for contractual and tortious liability of state respectively. The concept of torts by the state has been evolved and discussed across various famous-landmark judgements in the country.
