ABSTRACT
Since 2014 Mozambique have been undertaking legal reforms on the laws of oil and gas sector as result of the recent discoveries of petroleum reserves in the Rovuma Basin, which may turn Mozambique into the fourth country with largest resource reserves in the world. This contribution provides an analysis on the contractual approach of Mozambique to guarantee the correct and profitable exploitation of the natural resources (hydrocarbons) which, according to the Constitution belong to the State, such as it is the case of many other jurisdictions. In this study we will look to the jurisdiction of Ghana, The United Kingdom comparing with the Mozambican jurisdiction to assess in what extend the legal reforms are in line with the modern legal frameworks when it comes to oil and gas exploitation. Although oil and gas exploitation may be guaranteed through a Concession contract, Production Sharing Contract or Service Contract, in this study the focus will be in the Concession Contract which seems to be the one adopted by Mozambique.
