Comparative Analysis Of Competition Law And Intellectual Property Rights: Interplay With Special Reference To India And The USA

ABSTRACT

The laws created for the present day competitive era are allied with the idea of creating a balanced market that protects the interests of people and offers them all an equal chance to thrive for the existence of their business. The protection of business owners' rights and creating a welfare marketplace put light on the interplay of Competition Laws with Intellectual Property Rights. The long-term benefits from creation, innovation, and discovery are justified to be provided with an Intellectual Property Right that honors human intellect's credibility. Intellectual Property Rights protects the products of human intelligence from free duplicating or any other infringement that yields benefits to anyone other than the owner by providing license to them for their innovation. This paper brings out the necessary suggestions that India can adopt to improve the balance of its market.
