ABSTRACT

It cuts across received categories, creating myriad multilayered intersections, overlapping playing fields, and actors skilled at working across these boundaries. People are at once rooted and rootless, local producers and global consumers, threatened in their identities yet continually remaking those identities.”

This research critically examines commercial disputes in international arbitration, emphasizing the Indian context. Focused on legal, economic, and cultural dimensions, it evaluates the effectiveness of arbitration as a dispute resolution mechanism. Through in-depth analysis of legal frameworks, case studies, and recent developments in Indian arbitration laws, this study aims to enhance understanding, identify challenges, and propose improvements for a more efficient international commercial arbitration system, particularly in the Indian scenario.
