Commercial Arbitration: Enforcement Of A Foreign Arbitral Award

ABSTRACT

The article presented critically examines the Enforcement of foreign arbitral awards and their credibility. It describes the legal background regarding foreign awards, the rulings of the Supreme Court of India and the enforceability through the conventions. The rules provided under the Arbitration and Conciliation Act of 1996, Geneva Convention on the Execution of Foreign Arbitral Awards, 1927 (“Geneva Convention”) and the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, 1958 (“New York Convention”).

The article will also describe the recent cases and the rulings of the High Court and The Supreme Court OF India regarding the enforceability of a foreign award.
