ABSTRACT
The UCC, abbreviated as the Uniform Civil Code, mainly deals with harmonising religious and gender-based controversies in the nation. The term UCC, when viewed in a general context, solely talks about one country and one law. This article deals with the constitutional perspective and the ongoing debate on a uniform civil code.
Keywords: UCC (uniform civil code), Religion, Gender, and Controversy.
Introduction
As we all know, the preamble establishes the fact that India is a socialist and secular country, which also talks about equality in terms of status and opportunity. Though it is a secular nation, it deals with a lot of problems relating to religion in matters of marriage and inheritance, and when viewed in terms of gender, we prioritize them based on their dominance and follow a customary practice of making the male gender the superior gender while the female gender is being neglected in terms of status and opportunities. Even when we have constitutional provisions (articles 14 to 18) ensuring equality, this is still a major issue faced by the citizens.
UCC and Society
In order to remove these problems and establish a common law over personal laws to govern the pillars of society, we find that the UCC (Uniform Civil Code) is needed, but most of us are still arguing to support their arguments in respect of these disputes. While it is considered real that the UCC will help keep society as a whole on the same page, the constitution of India talks about equality on the one hand, but the society upholds personal laws on the other, which makes it difficult to implement.
