Child Marriage In India: An Oblique Acceptance By The State?

ABSTRACT


This research paper pertains to the evil of child marriages in Indian society and legal status of child marriages in India. It also analysis the socio-legal impact. This research paper analyses the position of the Honourable Apex Court and various High Courts regarding child marriage. It also points out the lacunae under various personal laws and secular laws like The Prohibition of Child Marriage Act of 2006, The Indian Majority Act of 1875, The Dowry Prohibition Act of 1961 and The Code of Criminal Procedure of 1973. It also discusses about the changes which are imperative in combating the evil of child marriage.
