Challenges In Scrutinizing Cybercrimes Beyond Boundaries

ABSTRACT


In the contemporary and interdependent world, crimes over the digital and virtual world are escalating and are constituting remarkable threats to everyone, whether its an individual, an organisation or government authorities utilizing and operating over the web. The unconfined and limitless character of such offences poses distinctive confrontations for the law authorities, specifically when it comes to determining the jurisdiction and territorial extent of such cyber offences. Assimilation of evidence and mutual cooperation with international agencies comes as yet other hurdles where these authorities face disputes and disagreements.


The article aims to focus upon various setbacks that lawmakers and law agencies come across while undergoing investigations and prosecution of the law breakers in the cybercrimes. It underlines several complications that law enforcement authorities face including evidence collection beyond the boundary of its own nation and how Mutual Legal Assistance Treaties (MLATs) play a vital role in bringing the nations on the same page.


The article stresses upon the necessity of establishing uniform procedures and conventions, international teamwork, and development of technical assistance among the nations for overpowering cybercrimes and cyber offenders.
