ABSTRACT

Broadcasting in India, where law's crossroads meet, Tech evolves, internet's rise, challenges greet. TRAI's consultations strive for rules complete, Enforcement, a challenge, in this broadcast feat. Balancing freedom, content's fate, laws we must keep.

In a nation where television ownership spans across socio-economic strata, it becomes imperative to establish a comprehensive legal framework for broadcasting. This paper seeks to scrutinize the existing laws and regulations governing broadcasting, identify inherent shortcomings, and underscore the urgent need for amendments and novel legislation. A critical component of this analysis entails a comparative examination of the international and national perspectives on broadcasting. This comparative approach will facilitate a more comprehensive understanding of the existing regulatory framework's efficacy and shortcomings. Another formidable issue that demands attention is the rampant piracy that jeopardizes the rights of broadcasters. The protection of these rights and the establishment of effective anti-piracy measures constitute pivotal challenges in this domain. The allocation and management of spectrum resources for broadcasting agencies emerge as another critical concern, particularly in the context of the internet providers who serve as the platform for content dissemination. Furthermore, the delicate balance between content censorship and the preservation of freedom of speech and expression demands careful consideration. Is it possible to establish a definitive demarcation between these two principles, or will they continue to intersect and evolve in accordance with societal standards? This research paper endeavors to provide a comprehensive exploration of these pressing issues and emerging challenges in the field of broadcasting, aiming to contribute to the formulation of a more robust and adaptive legal framework for this pivotal industry.
