Facts of the case
1. On July 1988, Surrinder Lal Kapur, a senior bureaucrat in the Punjab government and an IAS officer hosted a dinner party at his residence in Chandigarh.
2. Amongst the guests was K.P.S Gill, director of general of the Punjab police.
3. Rupan Deol Bajaj and her husband, IAS officers of the Punjab cadre, were also present there.
4. Chairs had been arranged to form two semi-circles facing one another wherein the women would sit in one of the semicircles and then the men in the other.
5. Gill walked over to the women's semicircle and sat on a chair about five to six seats away from Mrs. Bajaj.
6. Gill then called out to Mrs. Baja and asked her to sit on the vacant chair next to him and pulled the chair closer to his as she was about to take her seat.
7. Gill repeated this gesture as Bajaj pulled the chair to its original position after which she returned to her original seat between two women in the semi-circle.
8. Minutes later, Gill approached and stood directly in front of Bajaj at a distance so close that his legs were about four inches from her knees.
