Sakshi Jhanwar, ITM University, Raipur, Chhattisgarh

Appellant- Church of God (Full Gospel) in India

Respondent- K.K.R. Majestic Colony Welfare Association

Court- Supreme Court of India under Special Leave Petition

Citation- (2000) 7 SCC 282

Bench- Justice M.B. Shah and Justice S.N. Phukan

Judgment- 30th August,2000

INTRODUCTION

This instance addresses the significant problem of noise pollution, particularly as it relates to religious activity. Is it proper to disturb the peace and quiet of the neighbourhood with speakers and audio amplifiers? Without a fact, no religion promotes or encourages the idea that using drums or voice amplifiers during prayers is a way to disturb other people's tranquillity. A socialised society cannot accept, for religious reasons, activities that frighten the old or the weak, students or youngsters napping all over the whole day or in the morning hours, or people exercising in various ways.

FACTS

Appellant, Church of God (full gospel) in India was situated near K. K. R. M. Colony (respondent), Chennai. Its prayer hall is designed for Pentecostal Christians and is provided with musical instruments like a drum set, triple banjo, guitar, and other instruments, for the purpose of reciting prayers.
