INTRODUCTION:

In court, the issue of divorce under Islamic law and the proper way to implement it has repeatedly come up. In this ruling, the ability of a Muslim woman to dissolve her marriage has been further upheld. Through this decision, Justice Krishna Iyer has ruled that a divorce is a legitimate option under Muslim law for both men and women. No matter if the wife has disobeyed her marriage obligations, she is still entitled to start the process of dissolution.
