Case Commentary On Swapnil Tripathi V. Supreme Court Of India

INTRODUCTION


The provision of right to access to justice has been established as a fundamental right by the virtue of Article 14 and Article 21 of the Constitution. It has been established as a part of right to life and personal liberty, as it is a means of enhancement in value of life of citizens by providing them with a ready platform to seek legal aid and recourse. However, for citizens to effectively utilize the right to access justice, it becomes equally important to spread awareness about the legal system and the operations of the judicial organ of the State. This was given recognition in the case of Swapnil Tripathi vs Union of India1, wherein the court opened the opportunity of providing the public with a juncture to observe the court proceedings. At the same time, the court issued guidelines to ensure that the privacy of the parties involved in the case is not affected and the dignity of the court is not interfered with.
