Case Analysis On Delhi Working Women’s Forum Vs Union Of India And Ors.

INTRODUCTION

This case was a public interest litigation filed by the Delhi working women’s forum on behalf of six working women who were harassed, sexually assaulted, and were raped by seven Army personnel. Public interest litigation was filed by the Delhi working women forum under article 32 of the constitution. This petition was filed by the Delhi working women’s forum seeing the pathetic plight of the six women who were subject to brutal harassment and indecent sexual assault

Facts:

  • The incident took place in a train. On 10th February 1993 six women namely Usha Minz, Shanti, Josephine kerketta, Rosy kerketta, Nilli and Lilli were traveling on Muri Express from Ranchi to Delhi. Miss Lilli, one of the victims has described the incident as follows

  • Miss Lilli said that she was traveling from her hometown to Delhi by Muri Express along with other women who were from the same village in SHI coach of Muri Express from Ranchi to Delhi

  • Ms. Lilli said that she was sleeping at Berth No.50 and one of her friends Shanti woke up and told that some persons were teasing her when it was around 11 o’ clock and the Muri Express was at khurja Railway Station.

  • She said that she and her friends woke up and saw 7 to 8 army personnel come near them. Then all the women got up and sat at their respective seats, then the army men began to molest these women.

  • Two Sikhs and 6 clean shaved men made Ms. Lilli and her other friends sit on lower seats and then they kissed and hugged these women and lured their body and breasts.
