Capital Punishment In India: A Critical Analysis

ABSTRACT


India is a developing country which is on its way to the top but has a lot of issues before it reaches there, one of those problem is increasing crime rate. There are a lot of legislations and laws to control these crimes but punishments are not sufficient to deter these increasing crime rates. The penalization should be severe to reduce the crime rate. There are different kinds of punishment in India such as capital punishment, life imprisonment etc. Capital penalization is the most severe form of punishment. The paper talks about capital punishment in India and and its different modes. The paper also explains 2 major theories of capital punishment in India, namely reformative and preventive theory. It also talks about the cost involved and the deterrence factor of Capital punishment. The paper also compare these theories with the results of the survey to find out meaningful results.
