Bytes Behind Bars: An Analysis Of How Digital Evidence Shapes ICC Convictions With A Focus On Indian Practices

Shreya Shekhar, Symbiosis Law School, Pune

ABSTRACT

The nature and accessibility of judicial evidence are changing as a result of the constant introduction of new instruments as technology advances. Criminal investigators and prosecutors' methods for gathering, analysing, and presenting evidence at trial are changing due to the proliferation, connectivity, and capabilities of camera-equipped and internet-enabled mobile devices, which record more data about people's activities and communications than ever before. This is especially true in international criminal cases, when the prosecution must show a substantial and diverse body of evidence to support several counts connected to intricate disputes.

The significance of this research lies in its potential to advance our comprehension of the evolving landscape of international criminal justice in the digital era. By shedding light on the role of digital evidence, the aim is to contribute to the ongoing discourse surrounding the effectiveness and equity of the ICC, while also providing insights that may inform policy and practices not only in India but also on a global scale.
