Buyer’s Cartel: A Growing Threat In Indian Competitive Markets

ABSTRACT

The Competition (Amendment) Bill, 2020 has recently proposed the inclusion of buyers’ cartels within the definition of cartels in section 2(c) of the Act. As a result of this proposed change, the Competition Commission of India (“CCI”) will now have the power to evaluate anti-competitive agreements between buyers under Section 3 of the Act. The present paper aims to define buyers' cartels, analyze their influence on competition, examine their situation in India and other jurisdictions.
