ABSTRACT
This paper examines the Brahmapuram Waste Plant Fire outbreak which occurred on the 2nd of March 2023, and attempts to analyse the catastrophic event in the context of rule of law principles. The Brahmapuram Waste Plant, located in the city of Kochi, Kerala, India was built for waste management but due to its mis-management, incidents of fire outbreaks became common. On 2nd March, 2023 yet another fire outbreak occurred and it turned out to be the biggest manmade disaster in the state of Kerala. A combination of factors, including the accumulation of waste, lack of proper waste management systems, failure of the state authorities to take appropriate action to address these issues can be attributed as the cause for the incident. The paper attempts to elaborate and address all the issues pertaining to the Brahmapuram Fire outbreak. Thereafter, by considering the five major dimensions of Rule of Law proposed by Professor Peter L. Strauss, an analysis is drawn as to whether the State authorities adhered to the principles of rule of law. The analysis highlights the violations of the rules of law and the negligence of state authorities.
