ABSTRACT
Bioprospecting, or the study of biodiversity for new resources, is critical for sustainable development, particularly in India, where abundant biological diversity offers enormous opportunities for innovation. However, this potential is frequently hampered by complicated intellectual property (IP) issues. As India attempts to improve its sustainability efforts, understanding the nexus of bioprospecting and intellectual property rights becomes critical. The growing relevance of preserving traditional knowledge and ensuring equitable benefit sharing among local communities necessitates a thorough analysis of these issues.
The article will investigate the intellectual property landscape around bioprospecting in India, highlighting the challenges that innovators confront in obtaining and utilising biodiversity responsibly. It will address how intellectual property laws promote or block green technology and ideas, emphasising the importance of reforms that accord with both environmental and economic aims. By addressing these issues, the essay hopes to contribute to a stronger framework that promotes sustainable practices while protecting the rights of indigenous groups.
