ABSTRACT
In the modern-day world and evolved India, Bigamy became the dissipate topic. Supported with the decreased appearance rate, the focus on this topic devolves to be inert for years in the country, as most religious literature affirmed decades ago on bigamy. While focusing on the legal status of bigamy, there is an obscures formality in delivering the justice, which begins from registering the complaint (private) and extends to the proof to prove it as a criminal offense, which can presumably be a synchronization lag between citizens and present-day judiciary. The Indian Penal Code and Criminal Procedure Code clarifies its concept, wherein it withers to clarify where to register the complaint. In present-day apprehension, the right to file a complaint is vested with a spouse of second marriage if cheated and denied for a spouse of first marriage who is also affected through second marriage. The regularity limits it as adultery for the spouse of the first marriage, and justice in such ambiance on the grounds of bigamy for the spouse of first marriage is not concentrated. The theme also holds some unclear circumstances as the act of second marriage without dissolving the first marriage is considered adultery or bigamy in the aspect of the first spouse alongside taking steps it as a criminal offense. Suppose the law does not involve such a topic, then it has to be recognized that there is a vacuity in legal concepts regarding such positions. Whereas there is much to focus on, provisions like amendments by legal acts, the findings in such studies in the current day’s problems are to be mooted and specified with this concept via philosophical perspective about current judicial rulings and variable panorama on a feasible content, with an unbiased utterance to detain the festering of the social justice. The discussion on concepts introduced is put forth in this paper.
