Sweety Kumari, ICFAI Law School, ICFAI University, Dehradun

ABSTRACT

In this modern era with the development of technology, there is also a need of development of the nation in its social structure. With the change in times, there have been many campaigns to advocate for women’s right which was finally given to them. Our laws aim to eradicate the discriminatory provisions between the genders, most particularly between men and women. But some of these laws that strengthen the position of women in the society are somewhere framed in such a way that there remains a loophole which is ultimately used by some so called feminist to harass the men.

In this article, we will look at some of these laws and how they, which were created for the protection of women are now used to pester innocent men and their families. We will also have a look at how this loophole, where this discrimination has come up before the Indian courts in the form of cases where women have played victim cards by coming up with false claims, destroying someone else life for their own cruel motives by taking the help of these flaws in the laws, and what the court has remarked about such cruelty and advocating for a gender-neutral laws.
