ABSTRACT


This article delves into the often-overlooked aspect of judicial dissent within legal discourse, shedding light on its significant role beyond mere disagreement. While consensus among judges is traditionally revered, this paper argues that dissent plays a crucial role in the evolution of jurisprudence and the maintenance of a dynamic legal system. The article tries to discuss various factors apart from the law point which influence the judge for dissenting from the majority. Additionally, this article delves into the implications of dissent for the broader legal landscape, examining its role in fostering public trust in the judiciary, promoting development of law, judicial independence etc. This research not only enriches our understanding of judicial dissent but also underscores its indispensable significance in shaping the trajectory of law and justice.
