Balancing Equity And Economic Justice: Alimony Awards And Economic Disparities In Indian Family Law

SYNOPSIS


The concept of alimony in Indian family law is rooted in the principles of justice, fairness, and protection of the economically disadvantaged spouse following the dissolution of a marriage. Nevertheless, the changing socio- economic environment in India, which is characterized by deep gender inequalities, paves significant questions on how to build the structure of alimony awards to provide equity and economic fairness.


This paper examines the role of alimony in the context of gender dynamics, economic inequality, and the legal framework surrounding divorce and separation in India. Historically, alimony has been viewed as a means for rendering financial assistance to the economically disempowered spouse, usually the wife, after divorce. However, with changing societal roles, women’s increased participation in the workforce, and rising economic independence, the traditional approach to alimony is being questioned.
