ABSTRACT
In India, the rights of persons with disabilities (PwDs) are protected and promoted through a robust legal framework, primarily governed by the Rights of Persons with Disabilities Act, 2016. This legislation aligns with the UN Convention on the Rights of Persons with Disabilities (CRPD), to which India is a signatory. The Act recognizes 21 categories of disabilities and ensures equal opportunities in areas such as education, employment, healthcare, and accessibility. It mandates 4% reservation in government jobs and 5% in higher education, while also emphasizing inclusive education and accessible infrastructure through initiatives like the Accessible India Campaign. Constitutional provisions under Articles 14, 15, 16, and 21 safeguard the rights of PwDs against discrimination and guarantee equal treatment. While significant progress has been made, challenges such as societal stigma and enforcement gaps remain. Continued advocacy and implementation efforts are essential to create a fully inclusive society where PwDs can thrive with dignity and equal opportunities.
