Article 19 And Farmers Protest: Striking A Balance Between Rights And Duties

ABSTRACT


This Research Paper aims to carry out an in depth analysis of the recent Anti Farm Law Protests with reference to the fundamental rights of Freedom guaranteed by Article 19 of the Constitution. For the benefit of the reader’s understanding, this research paper is divided into subsections. The first section is the Introduction, which briefly explains the three Farm laws, Article 19 and the details about the farmer’s protests. The second part is An Academic Study of Article 19, that explains the concept of freedom of speech, expression, to form unions, to assemble and to opt for any profession- all the six freedoms guaranteed to all Indian citizens with a constitutional perspective. The third section takes up the issue of Protests and Article 19, and provides information about the various protests that have taken place in the country historically and also critically examines the various restrictions Article 19 imposes on it’s exercise. For the reader’s benefit, a number of relevant case laws have also been cited and to summarize the research paper, a Conclusion is also included.
