ABSTRACT
An increase in transport and communication services across the globe has led to the rapid growth of trade and commerce between nations. The rise in international commercial transactions has led to a significant rise in disputes. Litigation nowadays is becoming progressively international in nature. Consequently, it has become increasingly frequent in international disputes for a recalcitrant party to attempt to disrupt the proceedings by bringing the dispute covered by the agreement before national courts and seeking an anti- suit injunction from those courts.
