ABSTRACT
The aim of the Anti-defection law was to reduce political defections, but owing to rising political dishonesty and corruption, the law never progressed effectively, and the question now is whether fulfilling the law's goals is a reality or a fantasy. Politicians used gaps in the law to benefit themselves. It is past time for our Parliament to have a watchdog, and our constitutional experts should examine the subject in order to battle the threat of corruption and desertion, which has undermined democratic principles. There have been many critiques about the Anti defection law since it came into force, many of them have talked about the loopholes, the partisan role of institutions, and the control of money over the political situations. Every law has been made keeping bona fide intentions, a law like anti defection was made on the same base, but today this law suffers due to the ill intent1. Many legal researchers have asked for a re-evaluation for this law because there are lot of intricacies involved with the current anti defection law in India.
