ABSTRACT
Every country, whether developed or developing generally administers three categories of persons, viz. the citizens, stateless persons and aliens including refugees. The Constitution or the specific refugee legislation of a particular country, provides for the fundamental or basic human rights for each such category of persons and guarantees their protection. Such protection provided by a state to the non- citizens or refugees is an outcome of some internationally accepted fundamental human rights of a person. It is for this reason that since centuries, several states have been granting protection to individuals and groups fleeing persecution, situations of internal conflict, war, or some regime that infringes their basic rights as citizens of the world. However, shockingly, most of the members of International Community, acting under the guise of internal social, political, economic and cultural security, have closed their doors to refugees, going against the very spirit of international cooperation and protection of human rights. This paper attempts to chapter-wise discuss some major human rights available to refugees worldwide. Further, besides establishing the existence of such rights, the paper would also deal with the enforcement mechanism available to refugees and asylum seekers in order to exercise their basic human rights.
