ABSTRACT

Intellectual property plays a major role in any country’s development. Intellectual property is the reason why innovation takes place. Without the protection of ideas, businesses and individuals would not reap the full benefits of their inventions and would focus less on research and development. Similarly, artists would not be fully compensated for their creations and cultural vitality would suffer as a result. Intellectual property refers to creations of the mind, such as inventions; literary and artistic works; designs; and symbols, names and images used in commerce.

This paper talks about limited aspects of Intellectual property in specific Design. This paper analyzes a recent landmark Indian case which will provide a clear understanding of the adverse effect which may occur in cases of design infringement under similar circumstances. This paper analyzes the Principles Relating to Award of Damages lay down by the High Court of Delhi in cases of infringement of Intellectual property.
