Analysis Of Adultery In India

ABSTRACT


Legal analyses of the laws governing married people's adulterous behaviour under various legal systems show that the social norms of "sexual morality," which prevailed at the time the laws were created, had a significant impact on the definition of adultery. S. 497 of the Indian Penal Code was drafted prior to the 150-year colonial era in India. Since its inception, the statute has been embroiled in contentious debates regarding a number of issues, including its gender biased approach, its reflection of cultural conflicts, and its equality clause. Strong arguments have been made for its retention, modification, or removal entirely from penal statutes. This reasearch has made an effort to explain these debates in modern India from a legal perspective. This essay made an effort to examine adultery from a legal perspective.
