Analysis Of Abortion Rights Under Feminist Jurisprudence

Jyothi Natarajan & Srinidhi Sarayu, BBA LLB (Hons.), Alliance University, Bengaluru

ABSTRACT

This paper explores the concept of abortion rights under feminist jurisprudence, analysing the arguments for and against the right to choose. Using a combination of legal and ethical analysis, the paper considers the history of abortion rights, the role of the state in regulating reproductive rights, and the impact of feminist legal theory on the debate. The paper argues that the right to choose abortion is a fundamental aspect of women's bodily autonomy and should be protected by the law. It further considers the limitations of current legal frameworks and suggests potential avenues for expanding reproductive rights under feminist jurisprudence. Overall, the paper aims to contribute to the ongoing discussion surrounding reproductive rights and the role of feminist legal theory in shaping the legal landscape.

Keywords: abortion rights, feminist jurisprudence, role of state, fundamental rights, reproductive rights
