Analysing The Hijab Ban From Minority Perspectives In India

ABSTRACT


This paper aims at exploring the hijab ban in the state of Karnataka, the situation giving rise to the case, the importance it plays in the realm of human rights, especially in the international sphere. Looking at the instance from the scope of the International Covenant on the Civic and Political Rights, Universal Declaration of Human Rights and the Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief, the paper aims to look at the various violations created by the peculiar issue. Looking at the issue from the lens of both substantive and formal equality, the paper tries to examine the intricacies linked to the ideological differences within the state as well. Further, the paper also goes on to discuss the issues that transpire from the intersectionality of gendered aspects of the ban, and further examine the overall impact of such a decision being upheld within the state.
