ABSTRACT
The Indian Constitution provides for the freedom of speech and expression under the part III, that is considered as a fundamental right. At times the same right is been assumed by the advocates of law and misused, to curb this the Contempt of Courts Act, 1971 is been implemented and contempt has been defined. The Judicial officers while convicting the advocates or any person for the offence of contempt, use an element of discretion and the same is also been misused by the judicial officers for their personal reasons. The author refers to case laws, the Indian constitution and analyses the provisions of the contempt of court act in order to bring out the misuse of the provisions of The Contempt of Court Act while convicting the potential offenders.
