ABSTRACT

While India is a developing country, crime is also on the rise. India has many laws to prevent and control crime, even though crime is on the rise due to inadequate punishments for crimes. To reduce the crime, rate the punishment should be severe. All punishments are based on the same objective of punishing the offender. In India, there are different types of punishments like the death sentence, life imprisonment, imprisonment, etc. The death penalty is known as the most severe punishment. This article talks about the status of the death penalty around the world and also defines the concept of the death penalty. Also explains the death penalty system in India. This article explains two main theories related to the death penalty, i.e., reformative theory and deterrence theory. The researcher also explained the rare occurrences in this study. This article deals with the abolition and retention of states and capital punishment in ancient India. This article provides a comprehensive overview of the death penalty in India and the methods of execution in India.
