An Analytic Study On OTT Censorship With Reference To India

ABSTRACT

This paper analyses the present scenario of regulation of Over the top content streaming services in India. It is known to us that OTT services have become extremely popular throughout the world and it is now redefining the meaning of entertainment to people. It has created a huge market for digital audio visual content but as we know that this mode of serving content to consumers is a comparatively new concept hence the field stands much unregulated till date. Due to this there has been abuse of Freedom of Speech and Expression in some cases and these platforms have time and again involved themselves into controversies through various contents. Therefore, a debate has been going on regarding whether these platforms or the content streamed by these platforms shall be censored or not. In this paper we have talked about present level of regulation by the government, different reasons which requires these platforms to be regulated and the challenges which may be faced in regulating such platforms with references to various provisions of different acts and statues, the Indian Constitution, relevant cases and case laws. This paper would serve as a complete study of the above mentioned topic dealing with all necessary legal aspects.
