ABSTRACT:
In recent times CBI has been highlighted in the newspapers more for its criticism rather than its benefits. Mainly regarding the falling of credibility. One of those major instances of falling credibility would be the recent news of Tamilnadu withdrawing its general consent from CBI to investigate. In June 2023, the Central Bureau of Investigation (CBI) lost the government of Tamil Nadu's general approval for an investigation. The government's action came in response to complaints from the ruling DMK that the BJP government at the Centre is "misusing" federal agencies to "silence" opposition politicians.
Before beginning any investigations in Tamil Nadu, the central investigation agency would now need to get approval from the state's administration. Tamil Nadu became the tenth Indian state to revoke its general approval for CBI investigations.
Followed by majority of opposition-ruled states, including Telangana, Kerala, West Bengal, Jharkhand, Meghalaya, Mizoram, Punjab, and West Bengal, Tamilnadu also withdrew general consent have revoked the CBI's general consent, preventing it from conducting business there.
This analysis mainly deals with the fall of credibility due to its challenges and the suggestions to avoid such challenges. This is an effort to find a way to make CBI an independent body by enacting a new separate act for CBI
