ABSTRACT
Necrophilia is a paraphilic disease which is also known as necrophilism, necrolagnia, necrocoitus, necrochlesis and thanatophilia which is a sexual attraction or any kind of sexual act which is done with corpse. It’s a pathological fascination with human dead bodies and desire to engage them is such sexual activities with them not considering their dignity and dishonouring their relatives and closed ones. The legal status of necrophilia in certain countries along with India is deplored in this study. Many countries have different laws but in India there’s no specific law that effectively protect the dignity of the corpse and accused are not punished nor treated for the disease they are suffering with. The penal codes of India have only two sections which talks about the “sex with corpse” that is the section 297 and 377 of the code. Necrophilia also results in many sexual diseases. This paper deals with necrophilia and related laws of different countries and India’s vague and ambiguous law on this disease.
