An Analysis Of The Protection Of Child From Sexual Offences Act, 2012

ABSTRACT

The POCSO Act was started because the IPC was insufficient and there was no strict legislation to effectively address and combat heinous crimes like sexual exploitation and abuse of children. The goal of government institutions was to protect children from crimes like sexual assault, sexual harassment, and pornography and to facilitate adequate legal machinery by establishing special courts for trial of such offences and matters related to them. This was done in accordance with Article 151 of the Indian Constitution, which requires states to safeguard children inside their borders, as well as the UN Convention on the Rights of the Child, which lays out a series of guidelines for states to follow in order to protect children's best interests.

Despite the fact that this legislation is generic in nature and applies to everyone regardless of caste, creed, gender, or religion, it specifically punishes those who commit crimes against children in both rural and urban sections of the nation.
