ABSTRACT
India's history concerning the right to freedom of speech and expression reflects a rich tapestry envisioned by its founding fathers to establish a nation where these freedoms would serve as robust safeguards against authoritarian misuse. This vision aligns with Benjamin Franklin's assertion that freedom of thought is integral to wisdom and public liberty hinges on freedom of speech. The media, wielding substantial influence in shaping societal opinions, has been a key player in this narrative. The Indian judiciary has consistently taken an activist stance in upholding and expanding these freedoms, including the right to silence, broadcasting rights, freedom to criticize, and press freedom. Post-independence, the media played a crucial role in keeping the public informed and fostering trust, yet it later faced criticism for prioritizing public interest over truth, leading to the emergence of media trials, a phenomenon observed globally. The significance of prioritizing press freedom remains paramount in maintaining a vibrant democracy.
