ABSTRACT
This paper deals with the various proposals of substitutes of capital punishment. As the eminent saying goes “An eye for an eye makes the whole world blind” which reflects the very fact that two wrongs will never make a right. And in addition to capital punishment being a degrading practice of human dignity, it has now become ineffective to serve the deterrence effect as well. This writing alludes a detailed analysis on the substitutes of capital punishment & an analysis will be made to assess the type of alternative most suitable to replace death penalty in India. A comparative assessment on the alternatives of capital punishment is drawn from two countries with common law system & two countries with civil law system. Furthermore, the impact of those alternatives on the society and on the crimes rate is critically analysed. Post which, we will further draw a conclusion on the type of alternative most fit for India. Post taking into account the alternatives, the impact of the alternatives on the society & the impact of abolishment of death penalty on crime rates, the best suitable approach for substituting death penalty in India will be recommended.
