Alternative Dispute Resolution With Judicial Adjudication

ABSTRACT

Alternative dispute resolution is the out of court settlement, mean settling the dispute without approaching the legal system. The dispute will be dissolved by the disputants in presence of 3rd impartial person or by the party to the dispute itself. This is one of the resolution method which is used in the grass root level begins in the family and continuing with the industrial dispute even in recent days it is extended to the criminal matters also. This system has not evolved recently after the adjudication process, it is the basic where the resolution of the dispute is used in the family level problems. These mechanisms have their legal identity the Legal Services Authorities Act, 1987 established the Lok Adalat system for the settlement of disputes cheaply and expeditiously. Section 30 of Arbitration and Conciliation Act, 1996 encourages arbitrators to resolve the dispute. Sec 89 of CPC says that settlement of dispute outside the court by arbitration, conciliation, or judicial settlement including settlement through Lok Adalat or mediation. So ADR mechanism will play effective role to reduce the burden of the court and help the people to solve their problem quickly and cost efficiently. These methods can be easily approached rather than judicial mechanisms.
