Advocate And His Duties Towards The Court And Client

ABSTRACT
If justice is what every civilized society strives for, and law is the means then advocating is no less than the tool for achieving it. An advocate is engaged in a profession and not a business. The paradigm holds that the principal aim of a professional is to serve society and not earn a profit. In contrast to a businessperson who prioritizes financial self-interest, advocates place the benefit of the clients and society above their self-interest. Like other humans, an advocate also works in various capacities. It is the advocate as an entrepreneur that conflicts with professionalism and draws criticism from society. There are various guiding principles laid down for the advocates so that legal professionals do not divulge from the path of service. In India, the Bar Council of India has formulated rules that inter alia prescribes the duty of advocates to the courts, clients, opponent, etc. These duties are not mere guiding principles, but rules and violations of these rules may result in professional misconduct and may attract punishments.
