Access To Justice: A Myth Or Reality

Susree Sinha, Assistant Professor in Law, Amex Law College, Bardhaman, West Bengal.

ABSTRACT

Justice as is always viewed to be a very herculean task both on the part of the seeker as well as the giver. The problem lies not in the laws but in the execution of it. Due to lack of diligence and handful of corrupt individuals the actual seeker of justice are rendered unheard and suffer silently at the whimsical irony of fate. They are often compelled to believe that justice seeking is only a privilege that the rich can afford. However the very essence of justice lies in the maxim 'Ubi jus ibi remedium', whereby it implies that if there is justice in the society there ought to be a remedy to a problem. This article tends to bring out the solution to this irony of fate as to why and how such sufferings are continuing and how to bring about a positive solution to such problems.
