A Uniform Civil Code: Towards Gender Justice

INTRODUCTION:


Many provisions of personal laws are often discriminatory towards women in matters such marriage, divorce and inheritance. The Uniform Civil Code is considered as significant step towards achieving gender justce.The relationship between gender justice and uniform civil code is complex and it requires a care consideration od socil and legal perspective. However, UCC brings uniformity which will help in addressing gender based issues by ensuring equal rights and opportunities for all genders.


GENDER JUSTICE:


Gender justice is a concept of ensuring equality, just and fairness to all genders without any discrimination. It aims at establishing an environment where individuals are not judged by their genders. It mainly focused on addressing gender based discrimination faced by the women and marginalized genders. It includes legal and social reforms to promote gender equity and inclusion. It ensuring providing equal access to opportunities and protect from all forms of discrimination.


Article 14 of the Indian Constitution provides that the state shall not deny to any person, equality before law and equal protection of law within territory of India. By the virtue of the Article 15, the State shall not discriminate any citizen of India on the grounds of race, religion, caste, sex and place of birth. Article 16 provides equal opportunity in matter of public employment irrespective any discriminatory grounds. Article 21 guarantees the right to life with dignity. Article 39 enshrines the concept of equal pay for equal work and Article 51A(e) provided the spirit of harmony and to renounce the practices derogatory to dignity of women.
