A Study Of The Rule Of Survivorship In Succession Under The Concept Of Hindu Undivided Family

ABSTRACT

Hindu Succession Act governs the succession or transfer of property from one generation to the other in Hindus. The definition of Hindus as provided under Hindu Marriage and Adoption Act and Hindu Succession Act give a very wide range to its jurisdiction or population under its regulations or ambit. This research tries to discuss the doctrine of Survivorship that falls under the very pecuniary characteristic the Hindu law, the Hindu Undivided Family. The role of women in coparcenary is also discussed in depth so as to also provide a clear distinction between males and females and their rights in a Hindu Undivided family. It is also important to understand that the current Hindu laws have emerged for a tradition that persisted in India after the end of the British Raj which left both the Indian civilisation and economy in shambles.
