A Research On Arbitration In Family Disputes

ABSTRACT

This research paper managed the research surround the alternate disputes resolutions methods in family disputes in India. Indian legal system is one of the oldest legal systems in the world. The Family Justice system is meant to assist people in resolving child care difficulties without having to go to court, which takes time, money, and stress. Arbitration is a kind of “Alternative Dispute Resolution” that takes place outside of the courtroom. It's the procedure that most nearly mimics a court hearing or trial, but it’s private and secret, and it’s done in the way that your professional arbitrator determines is appropriate for your family law issue. It is usually less costly, speedier, more confidential, and less official. The arbitrator, like a court, must apply the appropriate legislation to the facts, and any disputes arising from the party’s separation or divorce may be settled. This research paper specifically deals with Arbitration as a dispute resolution system in matrimonial maters. Further this research paper will deal with questions such as whether the number of family courts in India must be increased so as to quicker disposal of family matters and whether family courts should be given more power over arbitration dealing with matrimonial issues.
